Welcome to Opinyn.

Opinyn is a social decision platform where users can publish questions, dilemmas and other content, vote on available options, express opinions and view aggregated community results.

Before creating an account, you must read and accept this Sign-Up Agreement, the Terms of Use, Privacy Policy and Community Guidelines.

By selecting “I agree” and creating an account, you confirm that you have read, understood and agreed to the following:

Acceptance of the rules

By creating or using an Opinyn account, you agree to:

• comply with this Sign-Up Agreement;
• comply with the Opinyn Terms of Use;
• comply with the Opinyn Community Guidelines;
• acknowledge that your personal data will be processed as described in the Opinyn Privacy Policy;
• follow all applicable laws and regulations;
• respect the safety, privacy, dignity and rights of other users;
• use the reporting tools responsibly;
• promptly report content or behaviour that you reasonably believe violates these rules or applicable law.

If you do not agree, you must not create an account or use Opinyn.

Your acceptance constitutes an electronic agreement between you and Opinyn.

Age and eligibility

You must be at least 16 years old, or meet any higher minimum age required in the country where you live, to create an Opinyn account independently.

If you are below the age at which you may legally consent to the use of an online service in your country, you may use Opinyn only with valid permission from your parent or legal guardian.

By creating an account, you confirm that:

• the age and information you provide are accurate;
• you are legally capable of accepting these rules; and
• you are not prohibited from using Opinyn under applicable law.

Opinyn may request reasonable age or parental-authorisation verification where required for safety or legal compliance. Opinyn may restrict, suspend or delete an account if it reasonably believes that the user does not satisfy the applicable age requirements.

Your account

You agree to:

• provide accurate and current registration information;
• keep your login credentials confidential;
• not share, sell or transfer your account;
• not impersonate another person or organisation;
• not create an account using another person’s identity without permission;
• immediately notify Opinyn if you suspect unauthorised access to your account.

You are responsible for activity performed through your account unless the activity resulted from circumstances outside your reasonable control.

Community safety commitment

Opinyn is intended to help people share questions, opinions and decisions safely. By creating an account, you commit to treating other users respectfully and not publishing, sharing, promoting, requesting or encouraging prohibited content.

The following categories of content and conduct are prohibited:

A. Child safety

You must not publish, request, share, store, promote or facilitate:

• child sexual abuse material or the sexual exploitation of minors;
• sexualised images, videos, comments or descriptions involving minors;
• grooming, solicitation or inappropriate contact with minors;
• instructions or encouragement relating to child abuse or exploitation;
• content that exposes a minor to serious physical, sexual or psychological harm;
• identifying or private information about a minor without appropriate authority;
• any attempt to normalise, joke about or facilitate the sexual exploitation of children.

Suspected child exploitation or immediate danger to a child must be reported immediately through Opinyn’s reporting tools and, where appropriate, to the competent authorities or emergency services.

B. Nudity and sexual content

You must not publish or share:

• pornography or explicit sexual activity;
• visible genitalia or explicitly sexualised nudity;
• non-consensual intimate images or recordings;
• sexual exploitation, coercion or sextortion;
• content offering, requesting or facilitating sexual services where prohibited;
• secretly recorded intimate content;
• threats to publish another person’s intimate material;
• sexual content involving or apparently involving a minor.

Limited non-sexual content relating to health, education, art or public interest may be permitted where appropriately presented and lawful.

C. Bullying and harassment

You must not:

• threaten, intimidate, stalk, shame or repeatedly target another person;
• encourage others to harass or abuse someone;
• publish private information to intimidate or harm another person;
• mock or exploit a person’s illness, disability, trauma or private circumstances;
• send repeated unwanted sexual, degrading or abusive messages;
• create accounts or posts intended to humiliate another person;
• threaten violence, sexual assault, exposure or blackmail;
• organise coordinated harassment or mass reporting.

Disagreement, criticism and unpopular opinions are not automatically harassment. Context, severity, repetition and the risk of harm will be considered.

D. Hate speech and hate symbols

You must not attack, dehumanise, threaten or promote hatred or discrimination against people based on protected characteristics, including:

• race;
• ethnicity;
• nationality or national origin;
• religion or belief;
• caste;
• sex;
• gender;
• gender identity;
• sexual orientation;
• disability;
• serious medical condition;
• immigration status;
• or another characteristic protected by applicable law.

You must not promote hateful organisations, ideologies or symbols, except where content is clearly presented for legitimate educational, documentary, journalistic, historical or counterspeech purposes.

E. Violence and dangerous content

You must not publish, promote or encourage:

• credible threats of violence;
• instructions for committing violent crimes;
• terrorism or violent extremist activity;
• glorification or celebration of serious violence;
• graphic violence intended primarily to shock or abuse;
• dangerous challenges likely to cause serious injury;
• self-harm or suicide encouragement or instructions;
• animal cruelty;
• instructions for creating or using weapons to harm others;
• content that creates a serious and immediate risk to public safety.

If you believe someone is in immediate danger, contact the appropriate emergency services. Opinyn’s reporting system is not a replacement for emergency assistance.

F. Spam, scams and misleading activity

You must not:

• repeatedly post irrelevant or unwanted content;
• manipulate votes, engagement, rankings, Aura or platform statistics;
• use bots, scripts, fake accounts or coordinated inauthentic behaviour;
• conduct phishing, fraud, impersonation or financial scams;
• distribute malware or malicious links;
• misrepresent promotions, products, services or giveaways;
• buy, sell or exchange votes, accounts, followers or artificial engagement;
• use deceptive tactics to redirect users outside Opinyn;
• falsely claim to represent Opinyn or another person or organisation.

G. False or deceptive information

You must not knowingly create, manipulate or distribute materially false or deceptive information where it is likely to cause harm, defraud users, interfere with public safety or falsely represent a person, event, product or service.

This includes:

• manipulated media presented as authentic;
• harmful medical misinformation;
• fraudulent financial or investment claims;
• false emergency or public-safety information;
• impersonation presented as genuine;
• fabricated evidence intended to damage another person;
• coordinated disinformation or deceptive influence campaigns.

Opinions, satire and personal predictions are not automatically prohibited, provided they are not presented deceptively as verified facts and do not otherwise violate these rules.

H. Other prohibited content or conduct

You must not use Opinyn for:

• illegal activity;
• infringement of intellectual-property rights;
• unauthorised disclosure of personal or confidential information;
• human trafficking or exploitation;
• sale or promotion of illegal goods;
• circumventing platform security or enforcement;
• interference with Opinyn’s systems or normal operation;
• any conduct that creates a significant safety, legal or security risk;
• any other activity that violates the Terms of Use or applicable law.

When selecting “Something else” in the reporting system, the reporting user should provide a clear description explaining what happened and why the content or behaviour may violate the rules or applicable law.

Your duty to report violations

By accepting this Agreement, you agree that if you encounter content or behaviour that you reasonably believe may involve any of the violations listed above, you will promptly use Opinyn’s reporting function.

Available reporting categories may include:

• Child Safety
• Nudity or Sexual Content
• Bullying or Harassment
• Hate Speech or Hate Symbols
• Violence or Dangerous Content
• Spam, Scam or Misleading Information
• False or Deceptive Information
• Something Else

When submitting a report, you agree to:

• select the most appropriate category;
• provide an accurate description where requested;
• submit the report honestly and in good faith;
• not knowingly submit false, abusive or retaliatory reports;
• not use coordinated reporting to silence users merely because you disagree with them.

A report does not guarantee that content will be removed. Opinyn will assess available context, these rules and applicable law.

Where legally required, Opinyn may provide confirmation that a report was received, communicate its decision and offer an appeal or complaint process.

Reporting content through Opinyn does not replace contacting emergency services, law enforcement or another competent authority when someone may be in immediate danger.

User content

You remain responsible for the content you create, upload, publish or share through Opinyn, including:

• questions and dilemmas;
• answer options;
• photographs and videos;
• captions and descriptions;
• comments;
• usernames and profile information;
• votes and reactions;
• links and other materials.

You confirm that:

• you own your content or have all permissions necessary to publish it;
• your content does not violate another person’s privacy, copyright, trademark or other rights;
• your content is not unlawful, fraudulent or misleading;
• you understand that content published publicly may be viewed, shared or captured by other users.

You retain ownership of your content. By publishing content on Opinyn, you grant Opinyn a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to host, store, reproduce, display, adapt, format, distribute and otherwise use that content solely for operating, securing, moderating, improving and promoting Opinyn, subject to applicable law and the Privacy Policy.

This licence ends when the content is deleted from Opinyn’s active systems, except where continued storage or use is reasonably necessary for backups, legal obligations, safety, dispute resolution, enforcement, or where the content was lawfully shared or incorporated into another user’s permitted activity before deletion.

Votes, results and decisions

Opinyn provides community opinions, votes, statistics and aggregated results for informational, discussion and entertainment purposes.

Opinyn does not guarantee that:

• users are representative of the general population;
• voters possess relevant knowledge or experience;
• votes are complete, accurate, genuine, unbiased or statistically reliable;
• the majority answer is correct, safe or suitable;
• content has been independently verified;
• results will remain unchanged;
• another user’s statements are truthful or accurate.

Votes and results are not professional advice and must not be treated as:

• medical advice;
• legal advice;
• financial or investment advice;
• psychological or mental-health advice;
• emergency guidance;
• safety instructions;
• or a substitute for qualified professional judgement.

You remain fully responsible for evaluating information and making your own decisions.

To the fullest extent permitted by applicable law, Opinyn is not responsible for decisions, actions, losses, injuries, damages or other consequences arising from or connected with:

• reliance on votes or poll results;
• reliance on user-generated content;
• following another user’s recommendation;
• choosing the majority or minority answer;
• acting or failing to act based on information found on Opinyn.

Nothing in these rules excludes liability that cannot lawfully be excluded, including liability arising from fraud, intentional misconduct, gross negligence where applicable, or mandatory consumer-protection law.

Moderation and enforcement

Opinyn may review, restrict, label, reduce the visibility of, disable access to or remove content when it reasonably believes the content:

• violates these rules;
• violates applicable law;
• creates a safety or security risk;
• infringes another person’s rights;
• is fraudulent, deceptive or technically harmful;
• is necessary to restrict following a valid legal order.

Depending on the seriousness and circumstances, Opinyn may:

• issue a warning;
• remove or restrict content;
• temporarily limit features;
• restrict distribution or visibility;
• suspend an account;
• permanently terminate an account;
• preserve relevant evidence;
• notify competent authorities where required or legally permitted.

Opinyn may consider the context, severity, intent, actual or potential harm, previous violations and applicable law.

Where required by law, Opinyn will provide affected users with a clear statement of reasons and information about available appeal options.

Appeals and complaints

If Opinyn removes your content, restricts your account or takes another moderation action, you may be able to request a review through the method stated in the decision notice or by contacting info@opinyn.com.

An appeal should include:

• the account or content concerned;
• the decision being challenged;
• an explanation of why you believe the decision was incorrect;
• any relevant supporting information.

Submitting an appeal does not automatically suspend or reverse the original decision.

Opinyn may reject abusive, repetitive, fraudulent or manifestly unfounded appeals.

Privacy acknowledgement

By creating an account, you acknowledge that Opinyn will process personal data as described in the Privacy Policy, including data necessary to:

• create and manage your account;
• provide platform features;
• display and distribute content;
• record votes and interactions;
• maintain security and prevent fraud;
• enforce platform rules;
• process reports and appeals;
• comply with legal obligations;
• analyse and improve the service where permitted by law.

Acceptance of the Terms of Use is not consent to every type of personal-data processing. Where consent is legally required, such as for certain optional marketing or non-essential tracking activities, Opinyn will request it separately.

You may have rights regarding access, correction, deletion, restriction, objection, portability and withdrawal of consent, as explained in the Privacy Policy.

Platform availability

Opinyn may modify, suspend, limit or discontinue any feature where reasonably necessary for:

• maintenance or technical changes;
• security or fraud prevention;
• legal compliance;
• moderation and user safety;
• product development;
• circumstances outside Opinyn’s reasonable control.

Opinyn does not guarantee uninterrupted or error-free operation. Mandatory rights under applicable consumer law remain unaffected.

Suspension and termination

You may stop using Opinyn at any time and may request account deletion through the available account settings or by contacting info@opinyn.com.

Opinyn may restrict, suspend or terminate access where reasonably necessary because of:

• serious or repeated violations;
• illegal activity;
• threats to users or platform security;
• vote or engagement manipulation;
• fraud or impersonation;
• legal requirements;
• failure to satisfy age or eligibility requirements.

Where appropriate and legally required, Opinyn will explain the decision and provide an opportunity to appeal.

Provisions that by their nature should survive termination—including responsibility for prior conduct, intellectual-property provisions, disclaimers and dispute provisions—will remain effective after termination.

Changes to these rules

Voting records and statistics

I understand and agree that when I submit a vote, Opinyn records the selected answer, the relevant dilemma, the date and time of the vote and the account or internal user identifier connected to that vote.

I understand that Opinyn uses this information to count votes, display results, maintain general dilemma and voting statistics, prevent duplicate or manipulated voting, calculate participation features such as Aura, ranks, badges or Voting Identity, protect the integrity of the Service and improve Opinyn.

I understand that other users will generally see aggregated results, such as the number and percentage of votes received by each option, rather than Opinyn’s complete internal record connecting each vote to a voter, unless a feature clearly states that voting activity will be public.

I acknowledge that anonymised or aggregated voting statistics may remain after I delete content or my account where those statistics no longer identify me.

Opinyn may update these rules to reflect changes to the service, safety standards or applicable law.

Where changes materially affect your rights or obligations, Opinyn will provide reasonable advance notice where required. Continued use after the effective date may constitute acceptance where permitted by law. If fresh consent is legally required, Opinyn will request it separately.

Final confirmation

By selecting “I agree” and creating an account, I confirm that:

• I meet the applicable minimum-age requirements;
• the information I provided is accurate;
• I have read and agree to the Opinyn Terms of Use;
• I have read and agree to follow the Opinyn Community Guidelines;
• I acknowledge the Opinyn Privacy Policy;
• I understand that Opinyn results represent user opinions and are not professional advice;
• I understand that I remain responsible for my decisions and actions;
• I understand that Opinyn is not responsible for consequences arising from reliance on votes, results or user-generated content, except where liability cannot legally be excluded;
• I agree not to publish or support prohibited content;
• I agree to promptly report suspected violations that I reasonably encounter;
• I understand that violations may result in content removal, restrictions, suspension or account termination.
