Account and Data Deletion Policy

This Account and Data Deletion Policy explains how users may delete content, request deletion of an Opinyn account and exercise applicable rights concerning personal data.

It also explains what happens to User Content, votes, voting statistics, reports, moderation records, backups and information that Opinyn must or may retain for legitimate legal, safety and security reasons.

This Policy forms part of the Opinyn Privacy Policy and Terms of Use.

Right to delete an account

Users may request permanent deletion of their Opinyn account at any time.

Account deletion means deletion of the account and associated personal data, subject only to limited retention where necessary and permitted by applicable law.

Temporary deactivation, suspension or removal of the application from a device does not constitute account deletion.

How to request account deletion

A user may request account deletion through:

The request should be sent from the email address connected to the Opinyn account where reasonably possible.

Deleting the application is not account deletion

Deleting or uninstalling the Opinyn application from a mobile device does not delete:

Identity verification

Before deleting an account, Opinyn may take reasonable steps to verify:

Verification requirements must not be used to create unnecessary obstacles to account deletion.

If Opinyn cannot reasonably verify account ownership, it may request additional information or temporarily delay deletion to protect the account from unauthorised deletion.

Confirmation before deletion

Before deletion is initiated, Opinyn may display a clear confirmation explaining that:

Effect of a valid deletion request

After a valid deletion request is confirmed, Opinyn will normally:

Information deleted from active systems

Subject to lawful exceptions, account deletion will include deletion or irreversible anonymisation of:

Comments and conversation context

Where deleting a comment would make an existing conversation technically incoherent, Opinyn may replace the username and identifying information with a neutral label such as:

Votes and voting records

A vote may therefore remain included in the numerical total of a dilemma after the connection to the voter has been deleted or irreversibly anonymised.

Where a specific vote must be removed to honour an applicable data-protection right, Opinyn may recalculate:

Aggregated and anonymised information

Information that has been irreversibly anonymised so that it no longer relates to an identifiable person is no longer personal data.

Opinyn may retain anonymised or aggregated information, including:

Anonymous posts

Anonymous posts remain internally connected to a user account while the account is active.

Following account deletion, Opinyn will normally:

“Anonymous” does not prevent Opinyn from acting on a deletion request or lawful retention requirement.

Reports and moderation records

Deletion of an account does not automatically require immediate deletion of all reports and moderation records.

Ordinary moderation records will normally be retained for no longer than three years after the case is closed, unless a longer period is justified.

Child-safety and serious-threat information

Account deletion does not require Opinyn to destroy evidence that must or may lawfully be preserved for child protection, public safety, criminal investigation or legal proceedings.

Access to retained sensitive evidence must be restricted to authorised persons.

Security, fraud and ban-evasion records

Opinyn may retain limited information after account deletion where necessary to:

Backups

Personal data deleted from active systems may remain temporarily in protected backups.

Backup copies will normally be overwritten or deleted within 90 days.

During that period:

Backup retention may be extended only where required by law, security or disaster-recovery necessity.

Firebase, PostHog and other service providers

Opinyn may use service providers including Firebase and PostHog.

When an account is deleted, Opinyn will take reasonable steps to:

Deletion may not apply to information that a service provider independently processes as a separate controller under its own legal obligations.

Apple and Google accounts

Deleting an Opinyn account does not delete:

Opinyn will delete or invalidate authentication identifiers and tokens held for the Opinyn account where no longer necessary.

Users may separately manage connected applications through their Apple or Google account settings.

Push notifications

After account deletion:

Users may also disable notifications through device settings before deleting the account.

Marketing communications

Account deletion will stop marketing communications associated with the deleted account.

Opinyn may retain minimal suppression information, such as an email address or protected identifier, where necessary to ensure that a person who unsubscribed is not accidentally added back to a marketing list.

Such suppression information will be used only for that purpose.

Legally required retention

Opinyn may retain specific information where required by:

Retained information will be limited to what is necessary and will be deleted when the applicable obligation expires.

Legal claims

Opinyn may retain information necessary to:

Legal acceptance, consent and policy-version records may be retained for up to five years after account deletion where reasonably necessary, subject to any different legally applicable limitation period.

Suspended or banned accounts

A suspended or banned user may still request account deletion.

Opinyn will process the request but may retain limited information necessary to:

Account deletion does not cancel responsibility for conduct occurring before deletion.

A banned user does not obtain a right to create a replacement account by deleting the banned account.

Pending reports and appeals

If an account has an active report, complaint, appeal or legal dispute, Opinyn may:

Content copied by other users

Opinyn cannot delete copies that another person has:

Users may need to contact the relevant person or third-party service regarding copies outside Opinyn.

Opinyn may act against content reposted within Opinyn where it violates applicable rules or rights.

Data export before deletion

Before deleting an account, users may request access to or a copy of eligible personal data by contacting info@opinyn.com.

Where applicable, data may be provided in a structured, commonly used and machine-readable format.

A user is not required to request an export before deleting an account.

After deletion has been completed, Opinyn may no longer be able to recover or provide deleted information.

Withdrawing a deletion request

If Opinyn provides a limited deletion-processing period, the user may be able to cancel the request before permanent deletion is completed.

The confirmation screen or email will explain whether cancellation is available and how to request it.

Once deletion or irreversible anonymisation has been completed, the account and associated personal data cannot be restored.

Requests from parents or guardians

A parent or legal guardian may request deletion of an account believed to belong to an underage child.

Opinyn may request reasonable evidence of:

Requests concerning deceased users

Requests concerning a deceased user will be assessed according to applicable law, the user’s privacy, evidence of death and the requester’s legal authority.

Opinyn will not provide account access or disclose personal information solely because a person claims a personal relationship with the deceased user.
